BALI, ULTIMOPARADISO.COM – The Segara Apartment in Tanjung Benoa, Bali was finally successfully executed without any significant resistance from the party claiming to be the owner of the apartment. The execution carried out by the Denpasar Court took place on Wednesday (24/7) witnessed by the plaintiff’s attorney I Nyoman Edi Irawan, S.Pd., SH., MH based on the decision of the Supreme Court (MA) of the Republic of Indonesia Number 2591 K/Pdt/2021 dated October 13, 2021 which has permanent legal force.
This MA decision upholds the decision of the Denpasar District Court Number 419/Pdt.G/2019/PN Dps dated May 6, 2020, Jo the Decision of the Denpasar High Court Number 130/PDT/2020 which granted all the lawsuits of the plaintiffs who had rented The Segara Apartment since 2008.

The execution of The Segara Apartment began with a meeting of the parties at the Tanjung Benoa Village Office, attended by the applicant for execution, Peter John Sullivan and 9 friends represented by his attorney I Nyoman Edi Irawan, also the defendant’s attorney and the party claiming to be the owner of The Segara Apartment and the Denpasar Court Clerk led by Rotua Roosa Mathilda Tampubolon. After coordinating at the Tanjung Benoa Village Office, the Clerk together with law enforcement officers from the Denpasar Police and Koramil 1611-08/South Kuta Kodim 1611/Badung moved towards the execution object. The execution of The Segara Apartment went smoothly, safely without any significant resistance from the defendant or the party claiming to be the owner of the apartment. The execution was witnessed by the pecalang of Tanjung Benoa Traditional Village and received a positive response from the Tanjung Benoa community, because they hoped that the building on the land in their area could operate and provide benefits to the surrounding community, not be left like a ‘ghost house’.
In front of the plaintiffs and defendants, Mathilda then read the Minutes of Execution and stated that the apartment was returned to the plaintiff who won his case at the Supreme Court level. By handing over the keys to The Segara Apartment to the plaintiff’s attorney in this case I Nyoman Edi Wirawan, Mathilda said that the execution in this case carrying out the execution of the Denpasar District Court decision was declared complete.
Meanwhile, Nyoman Edi Wirawan, who was met after the execution of The Segara Apartment, admitted that he was satisfied with the performance of the Denpasar District Court, law enforcement officers and also the Tanjung Benoa community. Edi specifically appreciated the Tanjung Benoa community who also helped to maintain a conducive atmosphere during the execution. “For approximately 7 years since 2017, 9 tenants’ fates have been hanging in the balance over the apartments they rent. But today the Court has provided justice and recognized their rights to this apartment. Edi hopes that by returning the rights of these tenants, they can return to their activities in this apartment and can help the surrounding community.***
